These Terms of Use govern access to and use of assuredfreight.io and any related website operated by Assured Freight Lines Inc. (the "Site"). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

1. Scope and Relationship to Other Agreements

1.1 Scope. These Terms of Use apply solely to your access to and use of the Site. They do not govern transportation services.

1.2 Transportation Services Governed Separately. All transportation and logistics services arranged by Assured Freight are governed exclusively by the Assured Freight Terms and Conditions of Service and the Assured Freight Statement of Charges, each available on the Site and each in effect on the date a shipment is tendered. Nothing on the Site, and nothing in these Terms of Use, modifies, limits, or supersedes those documents.

1.3 Changes. Assured Freight may revise these Terms of Use at any time by posting an updated version on the Site. Continued use of the Site after posting constitutes acceptance.

2. Permitted Use

2.1 License. Assured Freight grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own internal business purposes and for evaluating or requesting transportation services.

2.2 Prohibited Conduct. You shall not:

• Use any robot, spider, scraper, crawler, or other automated means to access, monitor, or copy the Site or its content
• Harvest, extract, or collect email addresses, phone numbers, rate data, or other information from the Site
• Attempt to gain unauthorized access to the Site, its servers, or any connected system
• Introduce any virus, malware, or other harmful code, or interfere with the operation or security of the Site
• Submit false, fraudulent, or misleading information through any form on the Site
• Use the Site to transmit unsolicited commercial messages, or to solicit Assured Freight's customers or carriers
• Frame, mirror, or reverse engineer any portion of the Site
• Use the Site in violation of any applicable law or regulation

3. Intellectual Property

3.1 Ownership. The Site and all content on it, including text, graphics, logos, trade names, trademarks, service marks, layout, and design, are the property of Assured Freight Lines Inc. or its licensors and are protected by United States and international intellectual property law. The Assured Freight name and logo are trademarks of Assured Freight Lines Inc.

3.2 No License Granted. Nothing on the Site grants any license or right to use any Assured Freight trademark, logo, or content without prior written permission.

3.3 Submissions. Any feedback, suggestions, or ideas you submit regarding the Site are non-confidential, and Assured Freight may use them without restriction or compensation.

4. Rate and Service Information

4.1 Not an Offer. Rates, transit times, capacity information, service descriptions, and any calculator or estimate tool appearing on the Site are for informational purposes only. They do not constitute an offer, a binding quote, or a guarantee of service or capacity.

4.2 Binding Quotes. A rate becomes binding only when Assured Freight issues a written quote or rate confirmation for a specific shipment, and only for the validity period stated on its face.

4.3 Accuracy. Assured Freight endeavors to keep Site content accurate and current but does not warrant that it is free of errors, omissions, or outdated information, and may change content at any time without notice.

5. Quote Requests and Communications

5.1 Information You Submit. Information you submit through a quote request, contact form, or similar feature is handled in accordance with the Assured Freight Privacy Policy, available on the Site.

5.2 Consent to Contact. By submitting a quote request or contact form and providing your telephone number, you expressly consent to receive telephone calls, text messages, and emails from Assured Freight regarding your request and related transportation services, including messages delivered using an automatic telephone dialing system or prerecorded voice. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time by replying STOP to a text message, by clicking the unsubscribe link in any email, or by contacting Assured Freight using the information below.

5.3 No Confidential Relationship. Submitting information through the Site does not create a confidential, fiduciary, or contractual relationship between you and Assured Freight.

6. Third-Party Links and Services

6.1 Links. The Site may link to third-party websites or services, including carrier tracking tools, load boards, and payment processors. Assured Freight does not control and is not responsible for the content, accuracy, availability, security, or privacy practices of any third-party site.

6.2 No Endorsement. A link does not imply endorsement, sponsorship, or affiliation.

7. Disclaimers and Limitation of Liability

7.1 Site Provided As-Is. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. Assured Freight does not warrant that the Site will be uninterrupted, secure, or error-free.

7.2 Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSURED FREIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. Assured Freight's total liability arising from your use of the Site shall not exceed one hundred dollars ($100.00). This limitation applies only to Site use and does not apply to transportation services, which are governed by the Terms and Conditions of Service.

7.3 Indemnification. You agree to indemnify and hold harmless Assured Freight from any claim, loss, or expense, including reasonable attorney's fees, arising from your use of the Site or your violation of these Terms of Use.

8. Termination and General Provisions

8.1 Termination of Access. Assured Freight may suspend or terminate your access to the Site at any time, with or without notice, for any reason.

8.2 Governing Law and Venue. These Terms of Use are governed by the laws of the State of Florida, without regard to conflict of laws principles. Venue for any dispute lies exclusively in the state or federal courts located in Lee County, Florida.

8.3 Jury Trial Waiver. EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO TRIAL BY JURY IN ANY ACTION ARISING FROM OR RELATING TO THESE TERMS OF USE OR THE SITE.

8.4 Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in effect.

8.5 Entire Agreement. These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and Assured Freight regarding the Site.
